ARIZONA IS A COMMUNITY PROPERTY STATE. States, like: Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington & Wisconsin are community property states, which means that the property accumulated during the marriage becomes joint property even if it was originally acquired in the name of one partner. The basic idea is that husband and wife acquire a one-half interest in the community property. Upon dissolution of the marriage, Arizona Courts will usually divide the marital estate in a manner that is substantially equal.

Separate property is an asset that the individual spouse owner prior to the marriage, inheritance, and income or interest from that separate property. In some situations, a spouse may "gift" a separate property asset, which works to thereby transmute the status of the separate property asset into a community property asset. A legal argument can be made when one spouse places separate property funds into a joint bank account that such spouse meant to effectuate a gift to the other spouse.
